Long Term Lease Agreement - Loxton District Children's Centre

Pursuant to the Local Government Act 1999 s202(2).

Council is seeking community feedback on a proposed 21-year ground lease and 21-year facilities lease with the Loxton District Children’s Centre (LDCC) for the former NRM building and a portion of the land located at the corner of Coral Street and Kokoda Terrace, Loxton.

The Council has been working in partnership with LDCC to support the design and future construction of the new Childcare Centre. Finalising a long-term lease agreement represents the final step in the LDCC’s endeavours to establish a purpose-built facility to better serve the local community.

The proposal includes two separate leases—one for the building (facilities lease) and one for the land (ground lease), both for a 21-year term, with an option to renew for a further 21 years.

Section 202(2) of the Local Government Act requires Council to undertake public consultation before granting a lease or licence over community land. In addition, the business use of the lease and the proposed length of tenure require formal community engagement.

The proposed lease agreements will enable the Centre to expand its childcare services, and provide Out of School Hours Care (OSHC) for local families.

Background

To enable the occupation of the former NRM site by the Loxton District Children's Centre, the Council is required to undertake a staged approach to public consultation. Below is a timeline indicating consultations that have already been completed for this site (and their purpose).

    Consultation required to enable childcare services to be undertaken on site.

    Facilities lease agreement - former NRM Building

    Endorsement of a 5-year facilities lease agreement required to enable the Loxton District Children's Centre to occupy the former NRM building to extend their child care services.

    Community Land Management Plan (CLMP)

    A CLMP is required for any Council-owned land that will be leased to a party that intends to utilise it for business purposes. A lease cannot be granted to the Loxton District Children's Centre for the land to construct a new childcare facility without successful public consultation on the CLMP.

    Long-term lease agreement

    Following successful public consultation for the CLMP and its adoption in April 2025, two draft lease agreements have been released for community feedback. This is a requirement under the Local Government Act 1999 for any long-term lease or licence on Council land (21 years).
